The following information is intended as a partial summary or a paraphrase of certain, but not all of the covenants, restrictions and conditions of owning a home site in Tranquility at Carters Lake Any decision to purchase property should be made based on a complete review of the full documents, available from the Tranquility at Carters Lake Board of Directors. This summary may be changed at any time without notice, and is intended for information only.

Gently rolling hills and tumbling streams along the shores of Carters Lake provide a unique opportunity for discriminating homeowners. Tranquility at Carters Lake has become a unique built environment that complements the natural beauty of this forested property. Homes of enduring design with spectacular views are nestled into the private, natural terrain of Tranquility at Carters Lake. This lifestyle is what we call “Rustic Sophistication”.

ARCHITECTURE

Home styles have been selected for Tranquility at Carters Lake based on their rambling nature, rugged natural appearance and regional appropriateness. Characteristics of these homes include expansive porches, lap and shake siding with stone foundations and accents, gabled roofs and rambling footprints. The architecture complements the natural area through rough, coarse and natural exterior finish materials and warm colors consistent with the surroundings.

The minimum square footage requirements are 1,600 square feet of finished, heated space from two floors only, with the main floor a minimum 1,200 square feet.

An Architectural Control Committee (ACC) has been formed to review and approve all homes and other structures at Tranquility at Carters Lake prior to construction to assure the harmony of external design and general quality with the high standards of the neighborhood and the overall development. A consistent design theme will be adhered to such that the natural beauty of the area is maintained, and for the enhancement of each owner’s investment. .

Design options and materials representing the style that are approved for Tranquility at Carters Lake include:

An Application for Residential Construction (including a review of the General Rules & Regulations for Approved Builders) must be completed and submitted to the Architectural Control Committee for approval. No site work or construction may begin until approval by the ACC is obtained.

LANDSCAPING

The goal of natural landscaping is to blend the physical structure of a house along with structural features such as driveways, walks and retaining walls to its surrounding natural environment become an integral part of converting a house on a lot into a visually appealing home site. Tranquility at Carters Lake home sites are part of a mountain setting, and as such, natural landscaping will be different in appearance from typical suburban well-kept lawns and other formal features of homes.

All property at Tranquility at Carters Lake is subject to covenants and restrictions and administered by the Architectural Control Committee. Landscape plans, vista pruning plans, and any other land or vegetation altering plans are to be submitted and approved prior to any activity commencing on a home site.

Some of the covenants and guidelines are as follows:

A site plan must be submitted to the ACC for approval prior to site work commencement.
The removal or pruning of trees and shrubs to improve views or other purposes cannot be done until after construction is completed; and then only with on-site approval of the Tranquility at Carters Lake Architectural Control Committee. Natural special and/or irreplaceable features and native flowering trees and shrubs are not to be removed. These included rhododendron, native azalea and mountain laurel. Stands of these plants are to be flagged prior to any clearing. This includes large and/or “character” trees, rock outcroppings, springs and streams, and concentrations of azaleas and other wild flowers and shrubs.
Covenants generally prohibit signs and fencing.
Play equipment, solid waste containers, and similar non-natural features are tightly controlled.
 
Drives, parking, patios and paths are to be designed to blend in the natural environment.
Transformers, drains, culverts and similar features should be appropriately screened and blended into the environment.
The use of rustic fencing (decorative, as approved by the ACC), stone walls and other structural features are encouraged.
Natural mulching materials are to be used to cover exposed earth during and after construction. (Artificially-colored mulches, gravel, and lava rock are not permitted. Gravel, lava rock and the like are not approved materials.)

ORGANIZATION AND OTHER MATTERS

The Architectural Control Committee (ACC) is created as part of the Tranquility at Carters Lake Owners Association. The Association was originally under the control of the Developer until 2011 when it was turned over to the property owners in accordance with its by-laws. In addition to the items above, some additional (but not all) covenants and restrictions at Tranquility at Carters Lake are as follows:

Covenants apply to all lots and all structures.
Single family homes only.
No lot may be split, divided, or subdivided for sale, resale, gift, transfer, or otherwise.
Any erosion problem can be addressed and enforcement action taken.
Landscaping plans are to be approved by ACC.
No tree having a diameter of four (4) inches or more (measured from a point two (2) feet above ground level), can be removed except as part of an approved landscaping plan.
No temporary buildings.
No signs whatsoever.
Setbacks will be established by the ACC.
No fences or walls allowed without ACC approval.
All driveways are to be approved and may be only asphalt.
No antennae or similar devices can be installed without ACC approval.
No clotheslines are permitted; garbage cans must be screened.
Any storage tanks for water, liquid propane gas or any other home fuels must be buried underground.
Owners are required to maintain each lot and as well as all landscaping in good condition and repair and in accordance with approved plans.
Limitations on vehicles, must be garaged, garage doors to remain closed, no boats or campers on lots and other restrictions.
Playground equipment is to be located on rear of lot and subject to ACC approval.
No owner will discriminate in the conveyance of any property.
Animals limited to pets, and may be removed in the sole discretion of the Association board.
All occupants, as well as owners, are bound by all rules, covenants, and restrictions.
Unsightly conditions can be regulated and enforced by the board.
The use of any and all types of firearms in the community is prohibited.
No overhead utility lines, including lines for cable television are permitted.
No window air conditioning units may be installed.
No exterior lighting visible from the street shall be permitted as approved by the ACC. No pole mounted lighting of a type similar to street lighting or security lighting is permitted.
No artificial vegetation, limitations on exterior sculpture, decorative flags and the like.
Limitations on solar and other energy conservation equipment and installation.
Approved mailboxes to be provided by builder.
Any changes to the exterior must be approved by ACC.
Exterior security, such as window bars are not allowed.
Entry features constructed by the Developer on any Lot may not be altered.
No structure of a temporary nature allowed.
The side of all window treatments which can be seen at any time from the outside of any structure located on a Lot must be white or off-white.
Solid waste receptacles and removal are subject to rules and regulations.
The Association Board has responsibility to keep the development void of any unclean, unhealthy, unsightly, or unkempt condition on any Lot and control any condition that will or might disturb the peace, quiet, safety, comfort, or serenity of the occupants of surrounding property.
